Personal data is any information that can be used to identify an individual. We take measures to ensure that our clients' personal data is always secure in the hands of the data controllers and that the processing of personal data takes place in accordance with applicable data protection legislation, internal policies, guidelines and procedures.

The purpose of this privacy policy is to provide the natural person - the data subject - with information about the purpose, scope, protection and retention period of personal data processing at the time of data collection and during the processing of the data subject's personal data.

2. Applicable legal acts

The Personal Data Processing Law, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and other applicable legal acts in the field of privacy and data processing.

3. What is the Privacy policy?

The Privacy policy is the link between J Konsult and the natural person (hereinafter also - the User) who contacts J Konsult and/or its personal data processors and/or uses the J Konsult website and/or the services provided.

J Konsult is committed to protecting the User's personal data. The Privacy policy allows the User to understand what information is collected when the User submits their data to J Konsult or when J Konsult obtains it in other ways, why J Konsult collects this data, and how it will be used.

The Privacy policy also provides information about how J Konsult collects, processes, stores, deletes and protects the User's personal data, thereby ensuring that the User's personal data is processed lawfully, fairly and in a manner transparent to the User.

The policy applies to the User's personal data, to any processing of natural persons' data, and to the services provided to the User.

If J Konsult updates this policy, all changes will be published on the relevant website.

In order to provide the User with better and more suitable services, and to ensure, maintain, protect and improve existing services, J Konsult processes data aggregated from the provision of services.

The essence of the service provision is as follows: when an enquiry form is completed, the form and the personal data recorded in it are passed to specific service providers or sellers so that the User is offered the best available service or product.

4. For what purposes is the User's data collected?

The User's personal data will be passed to the service providers or product sellers selected by the User so that they can provide the User with the requested services or products. The User's personal data will be passed on for processing to data recipients who help J Konsult offer the User the best possible services or products.

Service providers or product sellers are only those companies that have taken official part in this platform and are, or may be, direct marketing service providers, product sellers, database administration service providers, database software maintainers, cloud computing service providers, market research or business analytics service providers.

The User's personal data is provided to the processors only to the extent necessary for the execution of a specific task or the provision of specific services.

Service providers and product sellers that have taken official part in this platform may process the User's personal data only in accordance with the instructions of J Konsult, and they may not use it for other purposes or pass it on to other persons without the consent of J Konsult. In addition, they are obliged to ensure the protection of the User's data in accordance with the requirements of applicable regulations (both national and international) and the written agreement concluded with J Konsult, which, among other things, requires the irreversible deletion of any of the User's personal data after the execution of the task assigned by us or after the termination of cooperation.

The User's personal data may also be passed to competent institutions or law-enforcement authorities, such as the national police or supervisory authorities, but only in response to their requests and only where this is required under applicable regulations, in the cases and in the manner set out in the applicable regulations.

5. What User data does J Konsult process?

This information is kept on J Konsult's servers, which are located in a secure infrastructure.

Personal information is not collected without the User's consent.

User data will not be transferred outside the European Union or the countries of the European Economic Area, however, if such a need arises, the User's data may be transferred only to countries that provide the same level of natural person data protection as that ensured by the European Union.

6. What means does J Konsult use for collecting and processing data?

J Konsult may automatically collect the data mentioned above and receive personal data that the User provides by completing a special enquiry form or by otherwise contacting and interacting with the website. J Konsult may also receive personal information from other online service providers. Likewise, J Konsult may engage third-party service providers to provide technical support in the provision of the service. J Konsult has access to information that the User has provided to these service providers and to third-party e-commerce service providers, in compliance with all provisions of the Privacy policy.

7. What is the legal basis for processing the User's personal data?

The User's personal consent - the User, as the personal data subject, by completing the enquiry and/or contact forms, gives consent to the collection and processing of personal data for the purposes stated in this Privacy policy. Likewise, the User consents to data processing for direct marketing purposes so that new and individual offers can be made (this consent may, of course, be withdrawn by the User). The User's consent is their free will and independent decision, which can be given at any time, thereby allowing J Konsult to process the personal data for the specified purposes. The User's consent is binding on them if it is given directly and unambiguously. The User has the right to withdraw previously given consent at any time by using the indicated channels of communication with J Konsult. The requested changes will take effect within three working days. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Service provision - in order for J Konsult to provide the User with quality services, J Konsult must collect and process certain personal data that is collected from the User on the J Konsult website so that it can be passed on to processors.

Legitimate interests - taking into account the interests of J Konsult, which are based on the provision of quality services and timely support to the User, J Konsult has the right to process the User's personal data to the extent that is objectively necessary and sufficient for the purposes set out in this Privacy policy. Personal data processing by carrying out direct marketing, as a result of which the User is presented with new and/or individual J Konsult service offers, is considered to be a legitimate interest of J Konsult.

Performance of legal obligations - J Konsult has the right to process personal data in order to fulfil the requirements of regulations, as well as to respond to lawful requests from state and municipal authorities.

8. Exceptions to the disclosure of User data

J Konsult has the right to disclose personal data only in the cases provided for in regulations.

9. What are cookies?

Cookies are small text files that a website saves on your computer or mobile device when you visit our website. On each subsequent visit, the cookies are sent back to the originating website or to a third-party website that recognises the relevant cookie. Cookies, among other things, allow the website to remember the user's chosen settings on subsequent visits, so that they do not need to be set each time. Cookies are not used to identify you personally.

J Konsult may use cookies as a means of obtaining information from the web server for the purposes mentioned above, by tracking the User's use of the site. If the User continues to use the website, the User consents to the use of cookies by J Konsult. Cookies contain information that is transferred to the hard drive of the User's computer. They help J Konsult improve the website and provide a better and more personalised service.

The data obtained is used by the maintainer of the J Konsult website and by Google, which obtains anonymous data that is not linked to a specific person or a specific IP address. 10. Retention period of User personal data

J Konsult will process the User's personal data for 12 calendar months from the moment the personal data is submitted, or longer if another retention period for personal data is stipulated by or arises from the laws and regulations of the Republic of Latvia and the European Union.

11. What are the security conditions?

By using J Konsult's services or contacting J Konsult, the User agrees to J Konsult's terms and conditions for the provision of services.

J Konsult ensures, continuously reviews and improves protection measures in order to protect the User's personal data from unauthorised access, accidental loss, disclosure or destruction. To ensure this, J Konsult applies modern technologies and technical and organisational requirements, including the use of firewalls, intrusion detection, analysis software and data encryption.

J Konsult carefully vets all service providers that process the User's personal data on behalf of and at the request of J Konsult, and also evaluates whether cooperation partners (personal data processors) apply appropriate security measures so that the processing of the User's personal data takes place in accordance with the delegation by J Konsult and the requirements of regulations. Cooperation partners are not allowed to process personal data held by J Konsult for their own purposes.

J Konsult accepts no liability for any unauthorised access to personal data and/or loss of personal data if it is outside J Konsult's control, for example, if the User has disclosed their personal data to third parties themselves.

In the event that the User's personal data is compromised, J Konsult will notify the User.

Likewise, J Konsult will, without undue delay, within 72 hours of the moment the breach becomes known to it, report information/data processing security incidents or potential incidents, as well as data/information security breaches, to the authorities and the natural persons involved, as required by applicable regulations and/or European Union laws, except where, under the principle of accountability, J Konsult is able to clearly demonstrate that the personal data protection breach is unlikely to result in a risk to the rights and freedoms of natural persons.

J Konsult stores all personal information received from the User in a protected database, with part of the data encrypted and the connection secured.
